Athlete agents receive compensation or are promised compensation for representing the interests of student athletes as defined under NDCC ch. 9-15.2.
An athlete agent:
- Recruits or solicits a student athlete to enter an agency contract. An agency contract is an agreement in which a student athlete authorizes a person to negotiate or solicit a professional sports services contract or endorsement contract on behalf of the athlete.
- Procures employment or offers, promises, attempts, or negotiates to obtain employment for a student athlete as a professional athlete or member of a professional sports team or organization for compensation.
- Advises and/or manages business affairs of a student athlete.
Registration
Athlete agents must register with the Office of the Secretary of State.
Athlete Agent in North Dakota Registration
To register as an athlete agent in North Dakota, submit an

Athlete Agents Registered in Another State
If you are registered as an athlete agent in another state, you have 2 options for registering in North Dakota:
- Submit an Athlete Agent Registration/Renewal Application (SFN 60891)
- Submit the following information
- Copy of the application for registration in the other state
- Statement that identifies any material changes in the information on the application or verifies there is no material change in the information
- Copy of the certificate of registration from the other state

Athlete Agent Records Upon Request
If you are a registered athlete agent in North Dakota, you must keep your records for 5 years and the Secretary of State may request to inspect these records.
Records must include:
- Name and address of each individual represented by the agent
- Each agency contract entered by the agent
- Direct costs incurred by the agent in the recruitment or solicitation of each student-athlete to enter an agency contract
